GENERAL TERMS AND CONDITIONS (GTC)

1. Applicability of the Terms and Conditions

1.1

The booking of Uff/Nico Garms is exclusively based on the following terms and conditions. These terms also apply to all future services unless explicitly different terms are agreed upon in writing. Oral agreements are not valid.

1.2

The client’s terms and conditions that deviate from the following conditions will not be recognized. Such deviating terms and conditions will not become part of the contract even if the artist does not expressly object to them.

2. Contract Cancellation

Cancellation by the client is possible under the following conditions:

  • Up to 6 months before the event, no cancellation fee will be charged.
  • From 5 months before the event, a cancellation fee of 30% of the total amount (excluding travel costs) will be charged.
  • From 3 months before the event, a cancellation fee of 50% of the total amount (excluding travel costs) will be charged.
  • From 2 months before the event, a cancellation fee of 100% of the total amount (excluding travel costs) will be charged.
  • From 1 months before the event, a cancellation fee of 100% of the total amount (excluding travel costs) will be charged.

2.3. All other bookings:

  • Up to 3 months before the event, no cancellation fee will be charged.
  • From 2 months before the event, a cancellation fee of 30% of the total amount (excluding travel costs) will be charged.
  • From 1 months before the event, a cancellation fee of 50% of the total amount (excluding travel costs) will be charged.
  • From 2 weeks before the event, a cancellation fee of 100% of the total amount (excluding travel costs) will be charged.
  • From 1 week before the event, a cancellation fee of 100% of the total amount (excluding travel costs) will be charged.
2.4

If a substitute booking is made for another date following the client’s cancellation, the cancellation fees will be regulated separately. Cancellation by the DJ is only possible due to force majeure, such as illness or accident. In such cases, the DJ will do everything possible to provide a suitable replacement for the client. The DJ will inform the client of the unavailability as soon as possible.

3. Liability

3.1

The client is solely responsible for personal and property damage during an event unless the damage is caused by grossly negligent or intentional behavior by the DJ. The client is liable for any damage to the DJ’s equipment and music media caused by guests during an event, whether negligently, grossly negligently, or intentionally. If the DJ is unable to perform the agreed services due to circumstances beyond his control (force majeure, natural disasters, official orders, disruptions at the client’s business, power outages or fluctuations, etc.), the client has no right to withdraw from the contract, claim damages, or withhold payment.

3.2 Additional Clause – Parade/Demo-Trucks

The client is obligated to provide the DJ with a workspace on the demo/parade truck that is adequately protected from rain and other potential water damage. This includes:

  • Rain: The workspace must be covered and protected from falling rainwater.
  • Water from water pistols or hoses: Measures must be taken to prevent water pistols, hoses, or other water-bearing devices from reaching the workspace and damaging or endangering the technical equipment or the DJ.
  • General water damage: The workspace must be designed and secured to prevent any external water from impairing the functionality of the technical equipment or posing a risk to the DJ. The client is responsible for providing all necessary protective measures to ensure compliance with these requirements. If these protective measures are not met, the DJ reserves the right to cancel the performance without any reduction in the agreed fee.

4. Miscellaneous

4.1 Food / Drinks / Expenses

Non-alcoholic beverages and appropriate vegan food for longer events must be provided by the client. Other expenses are to be agreed upon separately.

4.2 Arrival and Departure

The DJ will organize and book their arrival and departure. Costs for travel will be billed to the client afterward. The booking will be made at a reasonable cost. Costs for taxi/Uber rides between the train station/airport and the accommodation, as well as for the journey to and from the venue, will also be covered. Receipts will be submitted by the DJ. Train tickets will be booked in second class, including a seat reservation. For flights, economy tickets will be booked, including checked baggage (min. 20 kg).

4.3 Accommodation

For bookings outside Berlin, the client will organize accommodation for the DJ. The client will cover the costs for the accommodation and any potential late check-out fees. If booking a hotel room, it must be at least a 4-star hotel with a room size of at least 18 m², including a double bed. If departure is after 12 noon, the client will book a late check-out for the DJ on the day after the booking.

4.4 GEMA Fees

All applicable fees will be paid directly by the organizer/client and remitted to GEMA. For purely private events, GEMA fees are not applicable.

4.5 Workspace

The client is responsible for ensuring that the DJ has sufficient space and furniture (a table approx. 1 x 2 m) to set up their equipment. The client will provide the necessary (secured) power connections (Schuko socket 230 V). The DJ’s workspace must not be dirty or uneven. The client ensures that the equipment is protected from sun exposure, rain, or other external factors. If the performance is canceled for any of these reasons, the full fee remains payable. 4.6 Changes

All changes to the contract must be made in writing.
